RICO Ruling Raises Stakes for GA Prenups

prenup lawyer Roswell, GA

If you're weighing whether a prenuptial agreement is worth the conversation before marriage, a recent Georgia Supreme Court ruling gives you one more reason to think it through carefully. The court confirmed that Georgia's Racketeer Influenced and Corrupt Organizations Act, originally written to target organized crime, can now be applied to disputes between former spouses. That decision changes the financial and legal stakes of divorce in ways that reach back into the marriage itself, including how assets were disclosed and managed from the start.

What the Georgia Supreme Court Decided

The case involved a Paulding County dispute between an ex-husband and ex-wife over child support arrears. According to reporting from WABE, the state Court of Appeals had ruled that RICO didn't belong in what it called a "garden variety domestic dispute." The Supreme Court disagreed, unanimously, and reversed that decision.

A Georgia State University law professor quoted in the coverage pointed out that many of RICO's underlying offenses, like forgery and fraudulent communications, already show up regularly in family law matters. The court's ruling means those actions can now expose a spouse to the same kind of legal jeopardy once reserved mainly for organized criminal enterprises, including:

  • Treble damages, meaning three times the actual financial harm
  • Recovery of attorney fees for the prevailing party
  • Court injunctions
  • Potential referral for criminal investigation

That's a meaningfully higher bar of exposure than a standard breach of contract or fraud claim carries on its own.

Why This Matters Before the Wedding, Not Just After

Most people think about prenuptial agreements purely as a divorce planning tool. But the RICO ruling shifts some of that thinking earlier in the timeline. If financial misrepresentation, hidden assets, or falsified documents can now trigger racketeering exposure during a divorce, then the quality and clarity of financial disclosure at the start of a marriage becomes more important, not less.

A well-drafted prenuptial agreement does more than divide property in advance. It creates a documented record of what each spouse owned, earned, and disclosed before the marriage began. That record can matter significantly if a dispute later escalates into allegations of fraud or concealment, the very conduct now squarely within reach of Georgia's racketeering law.

What a Roswell Prenup Should Address Given This Ruling

Couples working through a Roswell prenup agreement should treat full financial disclosure as a central part of the process, not a formality to rush through. That includes:

  • A complete and itemized list of assets and debts held by each party
  • Clear language addressing how future income, businesses, and inheritances will be treated
  • Documentation showing both parties had independent legal counsel and adequate time to review the agreement

Sloppy or incomplete disclosure at the prenup stage can create exactly the kind of ambiguity that fuels contentious litigation years later. And with RICO now confirmed as an available tool in family disputes, the consequences of that ambiguity are no longer just financial. They can carry legal exposure that follows a person well beyond the divorce decree itself.

Working With Counsel Who Understands Both Sides

Drafting a Roswell prenup that holds up under scrutiny requires more than filling in a template. A Roswell, GA prenup lawyer understands how financial disputes actually unfold in Georgia courts and can anticipate the kinds of disclosure gaps that create risk later. Given how significantly the legal environment around family disputes has shifted with this ruling, that kind of foresight is worth building into the process from day one.

At Vayman & Teitelbaum, P.C., we help clients across Georgia prepare prenuptial agreements that are thorough, clearly documented, and built to withstand challenge if a marriage later ends in dispute. If you're engaged or planning ahead and want to talk through what a prenup can help you put in place, reach out to schedule a meeting with a member of our team.

If you’re looking for a divorce lawyer who combines the grit of a prizefighter, the patience of a kindergarten teacher, and the bedside manner of a seasoned therapist, Brianna Moscowitz is your person. I found Brianna at a time when I was navigating the emotional equivalent of a shipwreck. Not only did they keep me afloat, they helped me rebuild the damn boat. Stronger, smarter, and far more seaworthy. Brianna is, in a word, exceptional. Tough when the situation demanded it, honest even when it stung (which I appreciated more than I expected), and tirelessly hardworking. She was never out for blood, but always out for what was fair. And more than that, she genuinely seemed to care. I never felt like a case file or a transaction. I felt heard, respected, and protected. She explained everything in human, non-lawyer English. She had time for my questions (even the dumb ones). She never sugar-coated things, but somehow still managed to deliver tough truths with compassion and clarity. That, my friends, is a rare skill. If you’re in the market for a legal team that fights smart, listens well, and shows up with both integrity and empathy—this is where you want to be. Highly, wholeheartedly, five-stars-with-an-extra-gold-sticker recommend.

Leah was great! She picked up my case and came through in helping me win! She remained professional throughout, and even patiently put up with all of my questions. Thank you! Edit: And it has been confirmed the other side in this old case submitted fabricated text message conversations, could have gotten way more from them. Edit 2: New evidence suggests the other side even made fake domains, for fake emails to use in civil court. Stay Vigiliant!

Hiring Vayman & Teitelbaum, P.C was one of the best decisions I made in my life. They represented me pertaining to custody modification. Not only did I receive what we were fighting for, I got more! I received primary custody of my son. Out of all the things I’ve accomplished in my life, this was by far the biggest one. My son means everything to me. Seeing him daily and being involve more in his life has given my life more purpose. I’ll never forget this process. Ms.Zammit, Ms.Shipman and Ms.Horensky were more than exceptional. They were amazing. They got the job done. I would strongly recommend them to anyone seeking for help pretaining to custody modification! God bless.
