Family Lawyer Suwanee, GA

Family law covers the legal disputes that come out of domestic relationships: divorce, custody, support, property division, alimony, prenuptial agreements, adoption, guardianship, protective orders, and more.

Many people are surprised by how procedurally complex these cases become, even when the situation itself seems simple. Child custody is a good example. Most parents think it comes down to where the child sleeps at night, but it also involves legal decision-making authority, detailed parenting plans, school and medical decisions, modification standards, and the court's ongoing analysis of what serves the child’s best interests. That analysis involves factors you may not have considered. Georgia family law has various moving parts, and the decisions you make in the first weeks tend to set the tone for everything that follows.

Types of Family Law Cases We Handle in Suwanee

We represent clients in Suwanee and across Gwinnett County in the full range of domestic relations matters. Most commonly, we have handled the following:

  • Divorce. There's the legal process, and then there's considerations for property, support, custody, and debt. We handle contested and uncontested matters. We also assist clients who are getting ready to file when they aren't sure where to start.
  • High net worth divorce. When a marriage involves significant assets, business interests, or investments, the standard approach to property division doesn't hold up. You need financial analysis, not just a strong legal argument.
  • Child custody and visitation. We prepare for hearings and advocate for parenting arrangements that protect our client's rights. Georgia courts apply the best interests of the child standard to every custody and visitation determination. Child custody during divorce raises questions that must be answered as parents figure out custody arrangements.
  • Division of property. Georgia is an equitable distribution state. That means fair division, and not necessarily equal. The courts weigh several factors to determine an outcome. We handle disputes over what counts as marital property, how to value a business, how to handle retirement accounts, and who keeps the house. The specifics of dividing property during divorce help decide how property gets concluded.
  • Alimony and spousal support. These disputes depend on the length of the marriage, each party's income and earning capacity, and the lifestyle during the marriage. We represent both the spouse seeking support and the spouse contesting it. Understanding alimony in Georgia before you negotiate is vital.
  • Prenuptial and postnuptial agreements. A well-drafted agreement avoids the potential for future conflict. We draft the document, review the terms, and handle challenges of enforceability if the time comes to do so. Identifying assets before marriage is frequently where this work starts.
  • Modification. Life changes. An order that made sense two years ago may no longer reflect the actual situation. We handle modifications to custody arrangements, child support orders, and alimony when circumstances have shifted enough to justify it.
  • Contempt. Orders only work if they get followed. When they don't and support is not paid, custody schedules get ignored, or property is not transferred, contempt proceedings exist to handle these situations.
  • Adoption and guardianship. We oversee stepparent adoptions, independent adoptions, and guardianship matters when a child or adult needs a designated legal guardian.

What Is Important To Understand About Family Law Cases?

The Legal Framework You're Working Within

Georgia domestic relations law entails several core principles. The best interest of the child standard governs every custody matter. Courts look at the relationship each parent has with the child, both parent's ability to provide a stable home, how connected the child is to their school and community, and a range of other factors. It's not a checklist, it’s an analysis, and judges have discretion in how they apply it.

  • Equitable distribution. Means the court divides marital property in a way it considers fair, not necessarily down the middle. Financial contributions, the length of the marriage, each party's future needs, all of it goes into that determination. People sometimes assume 50/50 is the default, but it isn’t.
  • Modification requests. Requires showing a substantial change in circumstances since the original order was entered. Filing too early, or without the right showing, may not ultimately work in your favor.
  • Georgia allows fault and no-fault divorce. The overwhelming majority of cases are filed on no-fault grounds, that the marriage is irretrievably broken. And in any divorce involving minor children, the court will require a parenting plan before anything gets finalized. That document covers custody, visitation schedules, legal decision-making, and how disputes get resolved.

What Influences Family Law Cases

Courts notice when a parent is undermining the other parent's relationship with the child. It gets documented, and is viewed negatively against their case. Full financial disclosure is not optional, as judges have seen every variation of hidden assets and underreported income, and the consequences of getting caught are real. In modification cases, timing is important. Filing before you can clearly demonstrate a change in circumstances may not get you the outcome you wanted.

Family Law Case Timeline

No two family law cases have the exact same timeline, but the general process remains consistent. Here is what you can expect moving forward:

  • Filing and service: Petition is sent, and the other party gets served. If there are urgent custody or financial issues, temporary orders can be sought.
  • Discovery: Financial records, communications, relevant documents. Both sides exchange what they have and request what they need.
  • Mediation: In most contested Georgia family law cases, the court requires it before trial. Sometimes cases resolve here at this stage.
  • Pretrial: Motions, hearings, narrowing down what actually needs to be tried.
  • Trial: This goes before a judge, as Georgia family law cases don't go to juries.
  • After judgment: Modifications, contempt matters, and enforcement issues, these cases don't always end when the order is signed.

What to Bring to Your Consultation

Come prepared to your appointment with as much information as you can gather. The more organized you are, the further we get in one meeting. But don’t be too concerned about having it all now. If you have it, bring these to your consultation:

  • Financial records, such as tax returns, bank statements, pay stubs, and information about any debts.
  • If there are existing court orders that have an impact on your case.
  • Documentation for when you got married, when you separated, and when your children were born.
  • And if there are any prior agreements between the parties, written or otherwise, bring proof of those.

If you’re looking for a divorce lawyer who combines the grit of a prizefighter, the patience of a kindergarten teacher, and the bedside manner of a seasoned therapist, Brianna Moscowitz is your person. I found Brianna at a time when I was navigating the emotional equivalent of a shipwreck. Not only did they keep me afloat, they helped me rebuild the damn boat. Stronger, smarter, and far more seaworthy. Brianna is, in a word, exceptional. Tough when the situation demanded it, honest even when it stung (which I appreciated more than I expected), and tirelessly hardworking. She was never out for blood, but always out for what was fair. And more than that, she genuinely seemed to care. I never felt like a case file or a transaction. I felt heard, respected, and protected. She explained everything in human, non-lawyer English. She had time for my questions (even the dumb ones). She never sugar-coated things, but somehow still managed to deliver tough truths with compassion and clarity. That, my friends, is a rare skill. If you’re in the market for a legal team that fights smart, listens well, and shows up with both integrity and empathy—this is where you want to be. Highly, wholeheartedly, five-stars-with-an-extra-gold-sticker recommend.

Leah was great! She picked up my case and came through in helping me win! She remained professional throughout, and even patiently put up with all of my questions. Thank you! Edit: And it has been confirmed the other side in this old case submitted fabricated text message conversations, could have gotten way more from them. Edit 2: New evidence suggests the other side even made fake domains, for fake emails to use in civil court. Stay Vigiliant!

Hiring Vayman & Teitelbaum, P.C was one of the best decisions I made in my life. They represented me pertaining to custody modification. Not only did I receive what we were fighting for, I got more! I received primary custody of my son. Out of all the things I’ve accomplished in my life, this was by far the biggest one. My son means everything to me. Seeing him daily and being involve more in his life has given my life more purpose. I’ll never forget this process. Ms.Zammit, Ms.Shipman and Ms.Horensky were more than exceptional. They were amazing. They got the job done. I would strongly recommend them to anyone seeking for help pretaining to custody modification! God bless.
