Fulton County Family Law Experience

Built for Financial Complexity

A high net worth divorce is almost never straightforward. When the estate includes business ownership, stock option grants, real estate in multiple states, or seven-figure retirement accounts, you need attorneys who work alongside forensic accountants and valuation professionals. That's how we handle these cases.

Vigilance Over Marital Assets

Georgia law bars both spouses from making substantial changes to the marital estate while a case is pending. We monitor financial disclosures, account statements, and asset transfers closely. When a spouse is hiding assets, we know how to find them.

Types of High Net Worth Divorce Cases We Handle in Sandy Springs

Wealth comes in different forms, and so do the disputes when a marriage involving substantial assets falls apart. These are the cases we handle most frequently for high net worth clients in Sandy Springs.

  • Division of property. Classifying assets as marital or separate, then accurately valuing them, is the backbone of any high-asset case. We deal with real estate portfolios, brokerage accounts, business interests, and retirement funds. Georgia follows equitable distribution principles, meaning fair but not necessarily equal.
  • Alimony and spousal support. When one spouse significantly out-earns the other, support becomes a central issue. We build cases around actual financial data, not guesswork. Georgia courts have broad discretion in awarding alimony.
  • Business valuation disputes. A closely held business is often the single largest marital asset. Revenue projections, goodwill, and intellectual property all factor into the number. Getting that valuation wrong, or letting the other side dictate it, can cost hundreds of thousands of dollars.
  • Prenuptial agreements. A prenup may shield certain assets, but if it was executed under pressure, without full financial disclosure, or with unconscionable terms, it can be contested. We represent clients on both sides of these disputes.
  • Child custody. Custody disputes in affluent households raise questions about lifestyle, schooling, and each parent's capacity to provide. The child's best interests still govern, but the practical layers get more involved.
  • Divorce with complex financial instruments. Stock options, RSUs, deferred compensation, and cryptocurrency all require precise analysis. Valuation or timing mistakes create tax consequences that take years to fix.

Georgia Legal Requirements for High Net Worth Divorce

Georgia doesn't split marital property down the middle. It's an equitable distribution state, which means courts aim for a fair outcome based on the specific facts and circumstances of the marriage. For a high net worth couple divorcing in Sandy Springs, the gap between "fair" and "equal" can amount to millions of dollars.

Under O.C.G.A. § 19-3-9, property owned before the marriage or received individually as a gift or inheritance stays separate. In theory. In practice, separate property gets mixed with marital funds constantly. It gets deposited into joint accounts, used to renovate the family home, and reinvested alongside marital assets. Once commingling happens, the entire asset may become subject to division.

Courts derive their authority to divide property from O.C.G.A. § 19-5-13. Judges weigh factors like duration of the marriage, earning capacity, contributions to the estate including homemaking, and each party's separate holdings.

At least one spouse must have lived in Georgia for six months before filing, per O.C.G.A. § 19-5-2. Sandy Springs cases go to Fulton County Superior Court. Once filed, O.C.G.A. § 19-6-1 bars either spouse from substantially changing the marital estate. Georgia family law allows courts to award it based on need and ability to pay, but a spouse whose adultery or desertion caused the separation can be denied.

Alimony isn't automatic. Courts may award it based on need and ability to pay, but a spouse whose adultery or desertion caused the separation can be denied.

Important Aspects of a Sandy Springs High Net Worth Divorce Case

Tracing and Classifying Assets

This is where many high-asset cases are won or lost. The question isn't always what something is worth; it's whether it belongs to the marriage. A rental property inherited before the wedding might seem clearly separate. But if marital income paid the mortgage or both spouses funded renovations, the appreciation could be marital. Tracing funds to their origin is painstaking. It's also where outcomes get decided.

Uncovering Hidden Wealth

One spouse usually knows more about the family's finances than the other. That imbalance creates opportunity for concealment: unreported income, inflated business expenses, deferred bonuses, transfers to family members or shell entities. Forensic analysis of bank records, tax filings, and corporate documents can expose these tactics. Georgia courts penalize spouses who try to game the process, and discovery violations can shift how the remaining assets are divided.

Tax Consequences and Business Valuation

A $500,000 brokerage account is not the same as $500,000 in home equity once you account for capital gains and tax treatment of the transfer. We work with financial professionals so clients know the after-tax value of every asset, not just the headline number.

Business valuation is its own battle. Income-based, asset-based, and market-based methods produce different figures. Goodwill, intellectual property, and growth trajectory all get examined. We address buyout terms, operational continuity, and how to shield the business from the divorce.

Retirement Accounts and Standard of Living

Splitting a 401(k) or pension requires a Qualified Domestic Relations Order (QDRO), and errors in that document trigger unnecessary taxes or leave money on the table. In high net worth divorces, retirement assets can represent a substantial share of the estate. Deferred compensation and stock vesting schedules add another layer entirely.

Courts also examine the marital standard of living, such as housing, travel, education costs, and club memberships, when evaluating alimony claims. In Sandy Springs, where household budgets in affluent families run high, documenting this standard accurately is critical.

If you’re looking for a divorce lawyer who combines the grit of a prizefighter, the patience of a kindergarten teacher, and the bedside manner of a seasoned therapist, Brianna Moscowitz is your person. I found Brianna at a time when I was navigating the emotional equivalent of a shipwreck. Not only did they keep me afloat, they helped me rebuild the damn boat. Stronger, smarter, and far more seaworthy. Brianna is, in a word, exceptional. Tough when the situation demanded it, honest even when it stung (which I appreciated more than I expected), and tirelessly hardworking. She was never out for blood, but always out for what was fair. And more than that, she genuinely seemed to care. I never felt like a case file or a transaction. I felt heard, respected, and protected. She explained everything in human, non-lawyer English. She had time for my questions (even the dumb ones). She never sugar-coated things, but somehow still managed to deliver tough truths with compassion and clarity. That, my friends, is a rare skill. If you’re in the market for a legal team that fights smart, listens well, and shows up with both integrity and empathy—this is where you want to be. Highly, wholeheartedly, five-stars-with-an-extra-gold-sticker recommend.

Leah was great! She picked up my case and came through in helping me win! She remained professional throughout, and even patiently put up with all of my questions. Thank you! Edit: And it has been confirmed the other side in this old case submitted fabricated text message conversations, could have gotten way more from them. Edit 2: New evidence suggests the other side even made fake domains, for fake emails to use in civil court. Stay Vigiliant!

Hiring Vayman & Teitelbaum, P.C was one of the best decisions I made in my life. They represented me pertaining to custody modification. Not only did I receive what we were fighting for, I got more! I received primary custody of my son. Out of all the things I’ve accomplished in my life, this was by far the biggest one. My son means everything to me. Seeing him daily and being involve more in his life has given my life more purpose. I’ll never forget this process. Ms.Zammit, Ms.Shipman and Ms.Horensky were more than exceptional. They were amazing. They got the job done. I would strongly recommend them to anyone seeking for help pretaining to custody modification! God bless.
